Terms & Conditions

• Liability:
• You agree not hold us, any of our advertisers, our service providers, or affiliates responsible for any damages while using our service(s) whether real or implied at any time in the future. 
• You agree not to hold us responsible for any delay in service, interruption of service, lost or corrupt data.
• You agree not to hold us responsible for any errors in transcription or interpretation in content on any of the pages we create. 
• We provide space for hosting web pages but make no implied or express warranties about the reliability of this space or related services. 
• We are not responsible for any deletion, alteration, or loss of data due to network or system outages, file corruption, accidental deletion, or any other reasons. 
• We make no guarantees as to server reliability, speed, or consistency, and cannot be held liable for such. 
• You are responsible for regularly monitoring and creating backups of your images and files, and agree to use Moonlight Creations Studios services, resources, and infrastructure at your own risk.
• Content & Design Restrictions
• We will not create any sites related to, condoning, or promoting pornographic material, warez, violence, hatred, pirated files, criminal/illegal activity, offensive content, infringes on copyright, trademark, patent, trade secret or other intellectual property, or anything we so choose.
• We will not create any sites used mainly for hot-linking or storage unless the proper service contract has been purchased.
• Any sites created and discovered by us to be in violation of these rules will be removed from our servers and any payments made by you will NOT be refunded. 
• We reserve the right to remove any file or page from our servers that we determine is in violation of any of our rules, guidelines, regulation, or terms of service. 
• We do not allow content that infringes on copyright, trademark, patent, trade secret or other intellectual property.  This includes "warez" (pirated software), unlawful music files, copyrighted images or videos, etc.
• Designer Credit Link:
• All web pages create by us, regardless of design service, hosting service, or whether free or paid, will be required to show a small text link at the bottom of the each web page giving us credit as the creator of the page.
• Payment Info & Terms:
• All clients will be set up with their own personal payment page ensuring that they will not accidently make a payment on another client's account.
• Any and all payments you make are non-refundable.
• Initial payments for hosting service contracts are due upon the initiation of service, and will be due upon a prearraged date as agreed upon by us and the customer. 
• Payments for paid web page design services are due upon completion of web site, and when the customer has approved all content/design and wishes for the site to be uploaded to a server for publication and public access, or have site files forwarded to their possession.  Web site files will not be published or forwarded to the customer until payment has been made. 
• All payments for hosting service contracts are due upon a prearrange payment date of each calendar year.  Delinquent accounts will have their services terminated until payment has been made. 
• Service Cancellation
• Clients are not obligated to any long-term service with our brochure web site services, and may cancel their service with us at any time.
• Any payments made at any time during contract are non-refundable at the time of cancellation or at any time in the future.
• Our paid web site hosting services require a yearly subscription payment and is due at the time of service initiation or at a prearrange time as agreed by us and the customer.  This does not apply to our brochure web site design and hosting services. 
• Ad-Supported Services
• Our banner, image, and/or text advertising is targeted toward English speakering audiences.  Since advertising is our main source of income and compensation for delivery of free services, we insist that all web sites we create be in the English language.
• The content of the advertisements that we place on web pages about our products and services pertain to breast cancer awareness items, novelty tshirts, and mouse pads. 
• We cannot make any warranties what our 3rd party advertisers will display on web pages.  Their ad content is based on the content already displayed on web pages, and may display in such a random manner as to pertain to the same content, message, and products that you may also want to convey. 
• Service Revocation / Cancellation:
• We reserve the right to cancel your service if you violate any of the following:
• You have violated any rules of service or any Terms & Conditions.
• Late payments or payments not made for services.
• You attempt to remove, circumvent, or alter any of our advertising.  User pages on our free service are required to display any advertisement we choose.  Any attempts to undermine or avoid the display of the banner is considered a violation of this agreement and will render the site subject to immediate removal.
• We will terminate your web site and any content from our servers and all user information for conduct that it believes is harmful to our business, or any of its users, or partners, or any of the viewing audience.
• Use you website to promote or are promoted by the sending of unsolicited e-mail (spam) or bulk submissions to search engines, blogs, chatrooms, etc. or are used primarily as jumping points to other websites and have little inherent content.
• We may terminate user accounts, contracts, or service(s) at any time, without notice for conduct that violates any of our rules. 
• We will terminate user accounts and delete any and all user information for conduct that it believes is harmful to our business, to any viewers or users, or partners. 
• URL Submission:
• We submit the URL to your new web site or brochure web site to Google, Yahoo, & DMOZ.org for free.
• We do not guarantee that any search engines will successfully index or crawl your web site or list them in any of their directories.
